Federal Fair Housing Protections

The federal Fair Housing Act prohibits discrimination in the sale, rental, financing and advertising of housing because of:

  • Race or color
  • National origin
  • Religion
  • Sex, including sexual orientation and gender identity
  • Familial status, including families with children under 18, pregnant individuals and people obtaining custody of children
  • Disability

State and Local Protections

State and local fair-housing laws may protect additional characteristics. Depending on the property's location, these may include age or elderliness, ancestry, marital status, source of income or funds, military or veteran status, and the use, handling or training of a guide or support animal. Local ordinances may provide still more protections. Housing must be offered without discrimination based on any characteristic protected by applicable federal, state or local law.

What Fair Housing Laws Prohibit

Fair-housing laws generally prohibit housing providers, property owners and real estate professionals from taking discriminatory actions such as:

  • Refusing to sell, rent or negotiate for housing
  • Making housing unavailable or falsely stating that it is unavailable
  • Applying different prices, terms, conditions, services or privileges
  • Steering people toward or away from an area or property
  • Restricting access to brokerage, MLS, financing or other housing-related services
  • Publishing advertising that expresses a discriminatory preference, limitation or exclusion
  • Threatening, coercing, intimidating, interfering with or retaliating against anyone who exercises a fair-housing right or assists another person in doing so

Responsibilities of Property Owners

Property owners using our MLS listing service must comply with all applicable fair-housing laws when preparing advertising, responding to inquiries, scheduling showings, evaluating offers or applications, negotiating terms, selecting a buyer or tenant and completing a sale or lease. Listing remarks, photographs, showing instructions and other marketing materials may not communicate an unlawful preference or limitation.

Housing providers must also comply with applicable requirements concerning reasonable accommodations and reasonable modifications for people with disabilities. Any exemption from a fair-housing law is narrow and fact-specific, and some exemptions do not apply when a real estate broker is involved. Property owners should obtain qualified legal advice before relying on an exemption.

Report Housing Discrimination

A person who believes housing discrimination has occurred may contact the U.S. Department of Housing and Urban Development's Office of Fair Housing and Equal Opportunity. Complaints may be submitted through HUD's Report Housing Discrimination page or by calling 1-800-669-9777. State and local fair-housing agencies may also accept complaints and provide information about protections in a particular location.
